Application of These Terms

These Terms & Conditions apply to orders placed through the ELSELE website.

By placing an order, you confirm that you have had the opportunity to review these Terms and the relevant customer policies made available during your purchase.

Product Information

We aim to describe and present our products, materials, dimensions, colours and other characteristics as accurately as reasonably possible.

Minor visual differences may occur due to photography, lighting, screen settings, materials or normal manufacturing variations.

Nothing in this section affects statutory rights relating to defective or non-conforming goods.

Placing an Order

Adding a product to your shopping cart does not reserve that product and does not by itself create a contract.

Before submitting an order, please check the products, quantities, delivery address, billing information and other information entered during checkout.

By submitting the final order, you make a binding offer to purchase the selected products and acknowledge any payment obligation clearly presented during checkout.

Order Acceptance

After an order is submitted, you may receive an automated message confirming that we have received it.

Unless expressly stated otherwise, an automated acknowledgement of receipt does not itself mean that the order has been accepted.

Acceptance takes place when we expressly confirm acceptance, dispatch the goods or otherwise complete the transaction in a manner that constitutes acceptance under the applicable order and payment process.

Product Availability

All orders are subject to product availability.

Before acceptance, an order may be declined where reasonably necessary, including because of unavailable stock, an obvious technical or pricing error, payment problems, suspected fraud or legal restrictions.

If money has already been collected for an order that cannot be fulfilled, the relevant amount will be reimbursed.

Prices

The price applicable to your purchase is the price displayed during the order process, subject to the correction of obvious errors where permitted by law.

Where required by applicable consumer law, prices are presented inclusive of applicable taxes and mandatory price components.

Shipping or other additional charges are shown separately where applicable and before completion of the order.

A commercial return policy does not replace or restrict statutory withdrawal rights or legal remedies for defective or non-conforming products.

Defective or Non-Conforming Goods

Statutory rights relating to defective, damaged or non-conforming goods remain unaffected.

Depending on applicable law and the circumstances, statutory remedies may include repair, replacement, price reduction, refund or termination of the contract.

These statutory rights are separate from any voluntary commercial warranty that may expressly be provided.

Accurate Information

You are responsible for providing accurate and sufficiently complete information when placing an order.

The website must not be used fraudulently, unlawfully, to interfere with its operation or to obtain unauthorised access to systems or data.

Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

Mandatory rights and remedies concerning consumer protection, fraud, intentional misconduct, personal injury, product liability or other non-excludable matters remain unaffected.

Any limitation contained in these Terms applies only to the extent legally permitted in the jurisdiction applicable to the relevant claim.

ELSELE Content

Website design, original text, product photography, graphics, branding and other original ELSELE materials are protected by applicable intellectual property laws.

Protected materials may not be commercially reproduced, distributed or exploited without appropriate authorisation, except where permitted by law.

Personal Information

Personal information relating to website use, customer accounts and orders is handled in accordance with our Privacy Policy and applicable data protection requirements.

Updates to These Terms

We may update these Terms where reasonably necessary, including to reflect changes to our services, business operations or applicable legal requirements.

Updated Terms apply prospectively. Orders already concluded remain subject to the terms applicable to those transactions unless mandatory law requires otherwise.

Remaining Provisions

If any provision of these Terms is invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.

Mandatory statutory provisions take precedence where applicable.
